These Terms and Conditions (“Agreement”) govern the use of services provided by Urban Moving Company (“Company,” “we,” “us,” or “our”). By booking or using our moving services, you (“Customer,” “you,” or “your”) agree to comply with and be bound by these terms. If you do not agree with these terms, please refrain from using our services.
Urban Moving Company offers moving and storage services, including but not limited to local and long-distance moving, packing, loading, unloading, and temporary storage.
Booking:
To schedule a move, the customer must provide accurate information regarding the date, time, location, and nature of the items being moved. The Company reserves the right to refuse or reschedule services based on availability and the complexity of the move.
Deposit:
A deposit may be required at the time of booking to secure your moving date. The amount of the deposit will be specified at the time of booking.
Payment:
Full payment is due upon completion of the move, unless otherwise agreed in writing. We accept payments through various methods, including credit cards, debit cards, and other approved forms of payment.
Rates and Fees:
Our rates are based on the distance of the move, the amount of items, and the time required. Any additional charges (e.g., for packing materials, stairs, long carry, or additional labor) will be discussed before the move.
Access and Availability:
The customer must ensure that the moving location is accessible and available for the scheduled date and time. Any changes to the schedule or location must be communicated to us at least 48 hours in advance.
Packing:
Unless otherwise arranged, customers are responsible for packing their own belongings. If we provide packing services, the customer agrees to pay the specified fees for packing materials and labor.
Fragile Items:
Customers are responsible for informing us of any fragile, valuable, or irreplaceable items that require special handling. The Company is not responsible for damage to items that were not disclosed or properly packed.
Cancellation:
If you cancel your move more than 48 hours before the scheduled date, you will receive a full refund of your deposit. Cancellations made less than 48 hours before the scheduled move may result in a cancellation fee.
Rescheduling:
If you wish to reschedule your move, please notify us at least 48 hours in advance. Subject to availability, we will make every effort to accommodate your request, but rescheduling may be subject to additional charges.
Insurance:
Urban Moving Company carries standard liability coverage for items damaged during the move. However, this coverage may be limited and does not cover certain items (e.g., electronics, valuable antiques, or fragile items) unless additional insurance is purchased by the customer.
Customer Insurance:
We recommend that customers obtain additional moving insurance for valuable or fragile items. The customer acknowledges that they are responsible for obtaining such insurance if desired.
Damage:
The Company is not responsible for damage caused by pre-existing defects in items, poor packaging, or improper handling by the customer. We will take all reasonable precautions to protect your items, but damage may occur in the course of the move.
Delivery Times:
We will make every effort to complete your move within the agreed timeframe. However, delivery times may vary based on unforeseen circumstances, including traffic, weather, and other delays.
Delays:
If the move is delayed due to circumstances beyond our control (e.g., bad weather, road closures, etc.), the Company will not be held liable for the delay. We will notify the customer of any significant delays as soon as possible.
Company Equipment:
The customer agrees not to use or allow others to use our moving equipment, vehicles, or supplies for any purpose other than the move.
Customer Equipment:
The customer is responsible for ensuring that all items to be moved are safe to transport and properly secured for the move.
The following items are prohibited from being moved by Urban Moving Company:
The customer agrees not to pack any prohibited items in the moving truck. The Company reserves the right to refuse transport of any items deemed dangerous or illegal.
The customer agrees to indemnify and hold harmless Urban Moving Company, its employees, contractors, and affiliates from any claims, damages, or losses resulting from the customer’s failure to comply with these Terms and Conditions, including but not limited to failure to disclose fragile or high-value items or providing false information about the move.
Any dispute arising out of or relating to these Terms and Conditions shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in [Insert City/State], and the decision of the arbitrator will be final.
To the fullest extent permitted by law, Urban Moving Company’s liability for any claims, damages, or losses arising out of or relating to the moving services provided under this Agreement shall be limited to the total amount paid by the customer for the moving services.
This Agreement shall be governed by and construed in accordance with the laws of the state of [Insert State], without regard to its conflict of law principles.
Urban Moving Company reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website with an updated “Effective Date.” By continuing to use our services after such changes, you agree to be bound by the revised Terms and Conditions.
